HOW We Got Here

McConnell amendment to 2018 Farm Bill legalized hemp products produced from plants with less than .03% THC.

The 2018 Farm Bill unwittingly created a gray market for all THC products which can claim to be from legal hemp plants. Since delta-8 THC is sourced from hemp, and not from marijuana, it’s legal and unregulated at the federal level.

The gray market also exploits legal questions about synthetic THC products.

The science is complicated, but as legal cases proceed through the courts, there are now unregulated THC products being sold at hemp shops, convenience stores, and liquor stores throughout the state, as sellers exploit a system with no age restrictions, no testing, and no safety rails to create an estimated $10-15 billion dollar marketplace.

The PROBLEM

The sale of THC products is completely unregulated.

The real-world result is that all THC products are available throughout the state in convenience stores and smoke shops to ANYONE AT ANY AGE.

The products sold in Texas stores are FAR MORE DANGEROUS than those sold in regulates states like Colorado where rigorous testing and age restrictions are enforced.

Nobody knows what is in these products as there is ZERO TESTING and NO CONSISTENCY WITH DOSING nor labeling.

The TIMELINE of Intoxicating Hemp Industry Events

  • 2018

    Hemp Legalized Nationwide

    The 2018 U.S. Farm Bill legalized hemp with 0.3% Delta-9 THC but unintentionally allowed intoxicating cannabinoids like Delta-8 THC.

  • 2019

    Texas Legalizes Hemp

    Texas passed HB 1325, legalizing hemp and hemp-derived products, creating a loophole for Delta-8 THC and similar intoxicants.

  • 2020

    Delta-8 THC Emerges

    Delta-8 THC, chemically derived from CBD, gained popularity as a “legal” intoxicating alternative to marijuana.

  • 2021

    Texas Attempts to Ban Delta-8 THC

    The Texas Department of State Health Services (DSHS) declared Delta-8 THC illegal, leading to legal challenges.

  • 2022

    Delta-8 THC Remains Legal

    A Travis County judge temporarily blocked enforcement of the Delta-8 ban, keeping the product legal in Texas. This case is currently before the Texas Supreme Court.

  • 2024

    Federal Outlook

    The upcoming 2024 U.S. Farm Bill is expected to address intoxicating hemp products, potentially leading to stricter national regulations.

  • 2025

    SB 3 Introduced

    SB 3 is introduced and the Lieutenant Governor announces the banning of THC products as a legislative priority.

The EDUCATION Effort

Many do not realize the unregulated THC marketplace exists and further do not realize children can access these products easily at convenience stores, smoke shops, and through direct shipment.
